Confidential Filing

Written complaint submitted by the aggrieved individual to the Internal Committee within 3 months of the incident.

STAGE 02

Notice & Conciliation

IC issues notice to the respondent within 7 working days. Voluntary conciliation explored at complainant's request (no monetary settlement permitted).

Independent inquiry conducted following Principles of Natural Justice with full civil court discovery powers.

INTERNAL COMMITTEE (IC) CONSTITUTION

POSH COMPLIANCE FAQ

Are contract workers, interns, trainees, and third-party vendors covered under BARSYL's POSH Policy?
Yes. Under the POSH Act 2013 and BARSYL's policy, the protection extends to every woman entering the workplace—including regular employees, contractual staff, probationers, interns, daily wage earners, consultants, and visitors.
What if an incident occurs off-site at a railway track project or during official travel?
Under Section 2(o) of the Act, any place visited by the employee arising out of or during the course of employment—including project construction sites, tunnels, transit accommodations, and official client trips—is legally classified as an "Extended Workplace" and fully covered.
How is complete confidentiality guaranteed during and after an inquiry?
Section 16 of the POSH Act prohibits the disclosure of the contents of complaints, identity of parties, and inquiry proceedings. BARSYL enforces severe disciplinary action and legal penalties against any breach of confidentiality.
Can a complaint be filed if evidence is primarily electronic (WhatsApp messages, emails, virtual calls)?
Yes. Digital communications, screenshots, emails, call logs, and witness testimonies are fully recognized electronic evidence under the Indian Evidence Act and evaluated by the Internal Committee during inquiry proceedings.
